COVID UPDATE FROM GPS LAW OFFICE, PC – 10/19/2020
This is my October 19, 2020 Covid Update for Los Angeles area parents:
1. If your child is a LAUSD student, the teachers union and LAUSD have reached an agreement on assessments for children with disabilities (FINALLY):
Services will be provided on a one-to-one basis (one teacher/service provider and one student)
It is voluntary on the part of the LAUSD, participating unit members shall be allowed to withdraw from participation without reprisal, but shall be encouraged to provide at least 48-hour notice prior to withdrawing.
Assessments will be completed in a classroom with sufficient space for compliance with social distancing protocols and adequate air circulation.
Staffing may include a teacher/service provider and paraprofessional working under the direction of a teacher/service provider each working with a student.
In-person assessments are to be provided during the regular work hours of the employee
UTLA bargaining unit members and students shall be tested at a District testing facility or private facility of the member’s or family’s choice following the District’s protocol for COVID-19 and cleared before providing and/or receiving in-person services during the operational hours of the District facility
So, if the district is delaying on your child's assessment, if you have been asking about your assessments – you can get these done now. 2. LA Superior Court timelines – for those of you needing to file for limited conservatorships, the probate courts are about 6 months out right now. What does that mean for you? It means that if your child needs a LC and is 17 or about to be 17 or if this is something that you feel they need, then you need to get a plan in order NOW for this. If you’ve tried or are considering self-determination, take a look at my blog for details. Courts are doing remote hearings – those are the only cases I am doing at the moment – so you don’t have to worry about traveling with your child to a COVID filled courthouse – but you need to get that date calendared. Speak to a lawyer in your area or you can call us about that – we offer flat rate options and payment plans to make it affordable.
